TRAFFIC SAFETY PROGRAM
The Traffic Safety Program is a program, whereby, if the applicant complies with all of the terms of the program, the case will be dismissed. If the applicant fails to comply with any one of the terms of the program, the Delaware Municipal Court will accept the guilty plea and the applicant will be convicted of the offense(s) with which the applicant is charged. In either event, the applicant will not be entitled to any refund of any money paid to the Court or to the Defensive Driving Course described below. Only minor misdemeanor moving violations are eligible. Under the terms of the program, the applicant is responsible for all of the following:
PURPOSE
  1. Mail or otherwise deliver all of the following to the Delaware Municipal Court before your scheduled court appearance:
    1. Sign and complete the Application for Traffic Safety Program form acknowledging your acceptance of all of the terms contained in the application by clicking here;
    2. Sign and complete the guilty plea and waiver of trial contained on the reverse side of your ticket – OR – enter a guilty or no contest plea in writing, waiving all of your constitutional rights;
    3. Provide proof of automobile liability insurance covering your operation of the vehicle at the time that you committed the offense(s) with which you are charged;
    4. Enclose a check or money order in the amount of the total sum of all scheduled waivers for the offense(s) with which you are charged.
  2. Make independent contact with the National Safety Council, Central Ohio Chapter, Defensive Driving Course at (614) 324-5934 or log onto their website at www.nscddconline.com/delawaretraffic/. Sign up for, pay for, and complete the course. To qualify, the course must be a minimum of six (6) hours.
  3. Provide the Delaware Municipal Court with proof of successful completion of the Defensive Driving Course within 60 days after your scheduled court date by sending the original completion certificate to the Court. Copies of course completion certificates will not be accepted as proof of completion of the course.
  4. If for any reason you are ineligible for the program, the Court will notify you and schedule a new court date. In such an event, any money you have paid to the Court will be held as bond.
  5. This program is only open to those who have not previously utilized the program. You are ineligible for this program if this is not your first participation in the program or if your offense is not a waiverable minor misdemeanor moving violation. To participate in the program, you must expressly accept all of the terms of the program and waive any claim of error in the proceedings that may be based upon variation from any procedure otherwise provided for under Ohio law.
